Texas AG Abbott sues GSK over drugs
Texas Attorney General Greg Abbott filed a deceptive trade practices action today in Dallas against Glaxosmithkline LLC and SB Pharmco Puerto Rico Inc., claiming the British drug maker and its subsidiary falsely represented the benefits of their Kytril, Bactroban, Paxil and Avandamet drugs.
Abbott, through the office’s Consumer Protection Division, accuses Glaxosmithkline and Pharmco of manufacturing and selling “adulterated” lots of Kytril, Bactroban, Paxil CR and Avandamet in Texas between 2001 and 2004, and perhaps longer.
SB Pharmco operated a factory in Cidra, Puerto Rico, where the drugs were made. It was one of GSK’s largest manufacturing facilities worldwide and a major supplier of prescription drugs to the United States, Abbott’s petition says.
Pharmco Puerto Rico last year admitted it was guilty of U.S. charges relating to the manufacture and distribution of Kytril, Bactroban, Paxil CR and Avandamet produced between 2001 and 2005 at the now-closed facility. The drugs had a variety of problems including contamination with bacteria, cracked coatings rendering them ineffective, and being too strong or too weak.
Abbot’s suit accuses GSK and Pharmco of misrepresenting the drugs’ benefits and quality, causing Texans to buy them when they would not have otherwise.
Kytril is a drug used to prevent nausea and vomiting caused by cancer chemotherapy and radiation therapy. Bactroban is an antibiotic ointment, Avandamet is a Type II diabetes drug and Paxil CR is the controlled release formulation of the antidepressant drug Paxil. …
